Jak\u00e9 platby naopak pronaj\u00edmatel po\u017eadovat nesm\u00ed? Jak\u00fd je postup, kdy\u017e s obsahem vy\u00fa\u010dtov\u00e1n\u00ed nesouhlas\u00edte nebo jste v\u016fbec \u017e\u00e1dn\u00e9 vy\u00fa\u010dtov\u00e1n\u00ed slu\u017eeb neobdr\u017eeli? Pravidla pro roz\u00fa\u010dtov\u00e1n\u00ed a vy\u00fa\u010dtov\u00e1n\u00ed slu\u017eeb jsou stanovena zvl\u00e1\u0161tn\u00edm pr\u00e1vn\u00edm p\u0159edpisem, kter\u00fdm je s \u00fa\u010dinnost\u00ed od 1. 1. 2014 z\u00e1kon \u010d. 67\/2013 Sb., kter\u00fdm se upravuj\u00ed n\u011bkter\u00e9 ot\u00e1zky souvisej\u00edc\u00ed s poskytov\u00e1n\u00edm pln\u011bn\u00ed spojen\u00fdch s u\u017e\u00edv\u00e1n\u00edm bytu a nebytov\u00fdch prostor\u016f v dom\u011b s byty<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ob\u010dansk\u00fd z\u00e1kon\u00edk s ohledem na shora uveden\u00fd p\u0159edpis stanov\u00ed pouze r\u00e1mcov\u00e1 pravidla pro sjedn\u00e1v\u00e1n\u00ed slu\u017eeb, podle nich\u017e si pronaj\u00edmatel a n\u00e1jemce maj\u00ed p\u0159edn\u011b ujednat, kter\u00e1 pln\u011bn\u00ed spojen\u00e1 s u\u017e\u00edv\u00e1n\u00edm bytu nebo s n\u00e1jmem souvisej\u00edc\u00ed slu\u017eby zajist\u00ed pronaj\u00edmatel. Pokud takov\u00e9 ujedn\u00e1n\u00ed v n\u00e1jemn\u00ed smlouv\u011b chyb\u00ed, je pronaj\u00edmatel povinen zajistit po dobu n\u00e1jmu tzv. \u201enezbytn\u00e9 slu\u017eby\u201c. Nezbytn\u00fdmi slu\u017ebami jsou dod\u00e1vky vody, odvoz a odv\u00e1d\u011bn\u00ed odpadn\u00edch vod v\u010detn\u011b \u010di\u0161t\u011bn\u00ed j\u00edmek, dod\u00e1vky tepla, odvoz komun\u00e1ln\u00edho odpadu, osv\u011btlen\u00ed a \u00faklid spole\u010dn\u00fdch \u010d\u00e1st\u00ed domu, zaji\u0161t\u011bn\u00ed p\u0159\u00edjmu rozhlasov\u00e9ho a televizn\u00edho vys\u00edl\u00e1n\u00ed, provoz a \u010di\u0161t\u011bn\u00ed kom\u00edn\u016f, p\u0159\u00edpadn\u011b provoz v\u00fdtahu.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Obdobn\u011b vymezuje rozsah poskytovan\u00fdch slu\u017eeb i z\u00e1kon \u010d. 67\/2013 Sb., podle n\u011bho\u017e jsou slu\u017ebami zejm\u00e9na dod\u00e1vka tepla a centralizovan\u00e9 poskytov\u00e1n\u00ed tepl\u00e9 vody, dod\u00e1vka vody a odv\u00e1d\u011bn\u00ed odpadn\u00edch vod, provoz v\u00fdtahu, osv\u011btlen\u00ed spole\u010dn\u00fdch prostor v dom\u011b, \u00faklid spole\u010dn\u00fdch prostor v dom\u011b, odvoz odpadn\u00edch vod a \u010di\u0161t\u011bn\u00ed j\u00edmek, umo\u017en\u011bn\u00ed p\u0159\u00edjm\u016f rozhlasov\u00e9ho a televizn\u00edho sign\u00e1lu, provoz a \u010di\u0161t\u011bn\u00ed kom\u00edn\u016f a odvoz komun\u00e1ln\u00edho odpadu. N\u00e1kladem za slu\u017eby podle z\u00e1kona nejsou revize za\u0159\u00edzen\u00ed a sou\u010d\u00e1st\u00ed domu a odpisy domu, pop\u0159\u00edpad\u011b dal\u0161\u00ed podobn\u00e9 polo\u017eky.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pronaj\u00edmatel m\u00e1 pr\u00e1vo po\u017eadovat po n\u00e1jemc\u00edch placen\u00ed z\u00e1loh na \u00fahradu n\u00e1klad\u016f za slu\u017eby poskytovan\u00e9 s u\u017e\u00edv\u00e1n\u00edm bytu. V\u00fd\u0161i t\u011bchto z\u00e1loh si strany n\u00e1jemn\u00edho vztahu vz\u00e1jemn\u011b sjednaj\u00ed. Pokud k dohod\u011b nedojde, ur\u010d\u00ed pronaj\u00edmatel n\u00e1jemci m\u011bs\u00ed\u010dn\u00ed z\u00e1lohy za jednotliv\u00e9 slu\u017eby jako m\u011bs\u00ed\u010dn\u00ed pod\u00edl z p\u0159edpokl\u00e1dan\u00fdch ro\u010dn\u00edch n\u00e1klad\u016f na slu\u017eby z p\u0159edchoz\u00edho roku nebo posledn\u00edho z\u00fa\u010dtovac\u00edho obdob\u00ed nebo z n\u00e1klad\u016f odvozen\u00fdch s p\u0159edpokl\u00e1dan\u00fdch cen b\u011b\u017en\u00e9ho roku. Pronaj\u00edmatel m\u00e1 pr\u00e1vo zm\u011bnit v pr\u016fb\u011bhu roku m\u011bs\u00ed\u010dn\u00ed z\u00e1lohu v m\u00ed\u0159e odpov\u00eddaj\u00edc\u00ed zm\u011bn\u011b ceny nebo v p\u0159\u00edpad\u011b zm\u011bny rozsahu \u010di kvality slu\u017eby. <strong>Zm\u011bna v\u00fd\u0161e m\u011bs\u00ed\u010dn\u00ed z\u00e1lohy mus\u00ed b\u00fdt v p\u00edsemn\u00e9m ozn\u00e1men\u00ed \u0159\u00e1dn\u011b zd\u016fvodn\u011bna.<\/strong> Zm\u011bn\u011bn\u00e1 m\u011bs\u00ed\u010dn\u00ed z\u00e1loha se plat\u00ed nejd\u0159\u00edve od 1. dne m\u011bs\u00edce n\u00e1sleduj\u00edc\u00edho po doru\u010den\u00ed p\u00edsemn\u00e9ho ozn\u00e1men\u00ed nov\u00e9 v\u00fd\u0161e z\u00e1lohy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Skute\u010dnou v\u00fd\u0161i n\u00e1klad\u016f a z\u00e1loh za jednotliv\u00e9 slu\u017eby vy\u00fa\u010dtuje pronaj\u00edmatel n\u00e1jemci v\u017edy za z\u00fa\u010dtovac\u00ed obdob\u00ed nejpozd\u011bji do 4 m\u011bs\u00edc\u016f po skon\u010den\u00ed z\u00fa\u010dtovac\u00edho obdob\u00ed. P\u0159i nespln\u011bn\u00ed t\u00e9to povinnosti ve stanoven\u00e9 lh\u016ft\u011b je pronaj\u00edmatel povinen zaplatit n\u00e1jemci pokutu dle \u00a7 13 z\u00e1kona ve v\u00fd\u0161i K\u010d 50,&#8211; za ka\u017ed\u00fd zapo\u010dat\u00fd den prodlen\u00ed (nen\u00ed-li dohodnuta v\u00fd\u0161e pokuty jin\u00e1). Pronaj\u00edmatel m\u00e1 povinnost ve vy\u00fa\u010dtov\u00e1n\u00ed uv\u00e9st skute\u010dnou v\u00fd\u0161i n\u00e1klad\u016f na jednotliv\u00e9 slu\u017eby se v\u0161emi pot\u0159ebn\u00fdmi n\u00e1le\u017eitostmi, v\u00fd\u0161i p\u0159ijat\u00fdch m\u011bs\u00ed\u010dn\u00edch z\u00e1loh za jednotliv\u00e9 slu\u017eby, aby p\u0159\u00edpadn\u00e9 rozd\u00edly ve vy\u00fa\u010dtov\u00e1n\u00ed byly z\u0159ejm\u00e9 a kontrolovateln\u00e9.<\/strong> Obecn\u011b lze \u0159\u00edct, \u017ee sou\u010d\u00e1st\u00ed vy\u00fa\u010dtov\u00e1n\u00ed slu\u017eeb za konkr\u00e9tn\u00ed z\u00fa\u010dtovac\u00ed obdob\u00ed by m\u011bly b\u00fdt \u00fadaje o uhrazen\u00fdch z\u00e1loh\u00e1ch za slu\u017eby, \u00fadaje o skute\u010dn\u00fdch n\u00e1kladech a spot\u0159eb\u011b jednotliv\u00fdch slu\u017eeb, a to nejenom za konkr\u00e9tn\u00ed bytovou jednotku, ale i za d\u016fm jako celek, aby bylo mo\u017en\u00e9 vy\u00fa\u010dtov\u00e1n\u00ed zkontrolovat. <strong>Je-li vy\u00fa\u010dtovan\u00e9 nespr\u00e1vn\u00e9 \u010di neobsahuje v\u0161echny pot\u0159ebn\u00e9 \u00fadaje, m\u016f\u017eete proti n\u011bmu vzn\u00e9st do 30 dn\u016f p\u00edsemn\u00e9 n\u00e1mitky, pronaj\u00edmatel je povinen je do 30 dn\u016f p\u00edsemn\u011b vy\u0159\u00eddit. Sankce p\u0159i poru\u0161en\u00ed pr\u00e1v a povinnost\u00ed je pak upravena v ust. \u00a7 13 z\u00e1kona, tj. povinnost zaplatit pokutu 50,- K\u010d za ka\u017ed\u00fd den prodlen\u00ed se spln\u011bn\u00edm z\u00e1konn\u00e9 povinnosti.<\/strong> M\u00e1te samoz\u0159ejm\u011b pr\u00e1vo i nahl\u00ed\u017eet do podklad\u016f, ze kter\u00fdch pronaj\u00edmatel p\u0159i zpracov\u00e1n\u00ed vy\u00fa\u010dtov\u00e1n\u00ed vych\u00e1zel. Pokud n\u00e1jemce pronaj\u00edmatele p\u00edsemn\u011b po\u017e\u00e1d\u00e1, je ten povinen nejpozd\u011bji do 5 m\u011bs\u00edc\u016f po skon\u010den\u00ed z\u00fa\u010dtovac\u00edho obdob\u00ed dolo\u017eit n\u00e1jemci n\u00e1klady na jednotliv\u00e9 slu\u017eby, zp\u016fsob roz\u00fa\u010dtov\u00e1n\u00ed, stanoven\u00ed z\u00e1loh a umo\u017enit mu t\u00e9\u017e po\u0159\u00edzen\u00ed kopi\u00ed podklad\u016f. Finan\u010dn\u00ed vypo\u0159\u00e1d\u00e1n\u00ed p\u0159eplatk\u016f a nedoplatk\u016f m\u00e1 b\u00fdt provedeno v dohodnut\u00e9 lh\u016ft\u011b, nejpozd\u011bji v\u0161ak do 4 m\u011bs\u00edc\u016f od doru\u010den\u00ed vy\u00fa\u010dtov\u00e1n\u00ed n\u00e1jemci.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Pro \u00faplnost dod\u00e1v\u00e1me, \u017ee nap\u0159. platba za poji\u0161t\u011bn\u00ed domu, za spr\u00e1vu domu, poplatek do fondu oprav, poplatek za vybaven\u00ed bytu apod. nejsou pova\u017eov\u00e1ny za slu\u017eby spojen\u00e9 s u\u017e\u00edv\u00e1n\u00edm bytu a pronaj\u00edmatel je nesm\u00ed po n\u00e1jemci po\u017eadovat (viz. donucuj\u00edc\u00ed ust. \u00a7 2251 odst. 2 ob\u010dansk\u00e9ho z\u00e1kon\u00edku).<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I n\u00e1jemce m\u00e1 povinnosti ve vztahu k pronaj\u00edmateli. <strong>N\u00e1jemce je zejm\u00e9na povinen ozn\u00e1mit pronaj\u00edmateli p\u00edsemnou formou bez zbyte\u010dn\u00e9ho odkladu zm\u011bny v po\u010dtu osob rozhodn\u00fdch pro roz\u00fa\u010dtov\u00e1n\u00ed.<\/strong> Pokud tak n\u00e1jemce neu\u010din\u00ed, m\u00e1 naopak pronaj\u00edmatel n\u00e1rok po\u017eadovat pokutu podle \u00a7 13 z\u00e1kona ve v\u00fd\u0161i 50,- denn\u011b (nen\u00ed-li dohodnuta jin\u00e1 v\u00fd\u0161e). Pokud n\u00e1jemce neozn\u00e1m\u00ed zv\u00fd\u0161en\u00ed po\u010dtu osob ve sv\u00e9 dom\u00e1cnosti ani ve lh\u016ft\u011b do dvou m\u011bs\u00edc\u016f ode dne, co zm\u011bna nastala, m\u00e1 se za to, \u017ee z\u00e1va\u017en\u011b poru\u0161il svou povinnost a pronaj\u00edmatel s n\u00edm m\u016f\u017ee za podm\u00ednek stanoven\u00fdch ob\u010d. z\u00e1kon\u00edkem nav\u00edc ukon\u010dit n\u00e1jem v\u00fdpov\u011bd\u00ed.<br>Z\u00e1kon umo\u017e\u0148uje i mo\u017enost dohodnout se na pau\u0161\u00e1ln\u00ed platb\u011b za slu\u017eby. \u010c\u00e1stka n\u00e1jemn\u00e9ho a \u010d\u00e1stka za slu\u017eby se m\u016f\u017ee slou\u010dit do samostatn\u00e9 pau\u0161\u00e1ln\u00ed \u010d\u00e1stky, pokud si to pronaj\u00edmatel a n\u00e1jemce sjednaj\u00ed. Pro tento p\u0159\u00edpad plat\u00ed, \u017ee platby za poskytovan\u00e9 slu\u017eby se neroz\u00fa\u010dtov\u00e1vaj\u00ed. P\u00edsemn\u00e1 dohoda o pau\u0161\u00e1ln\u00ed platb\u011b nemus\u00ed b\u00fdt uzav\u00edr\u00e1na se v\u0161emi n\u00e1jemci v dom\u011b. Pau\u0161\u00e1ln\u00ed platby se uzav\u00edraj\u00ed ve v\u011bt\u0161in\u011b p\u0159\u00edpad\u016f pouze u kr\u00e1tkodob\u00fdch n\u00e1jm\u016f a nejde o \u010dast\u00e9 p\u0159\u00edpady. D\u016fvodem je p\u0159edev\u0161\u00edm ustanoven\u00ed v \u00a7 9 odst. 4 z\u00e1kona, \u017ee u n\u00e1jm\u016f uzav\u0159en\u00fdch na dobu del\u0161\u00edch ne\u017e 24 m\u011bs\u00edc\u016f nebo na dobu neur\u010ditou nelze do pau\u0161\u00e1ln\u00ed platby zahrnout platbu za dod\u00e1vku tepla a centralizovan\u00e9 poskytov\u00e1n\u00ed tepl\u00e9 vody a dod\u00e1vku vody a odv\u00e1d\u011bn\u00ed odpadn\u00edch vod. Platby za tyto slu\u017eby se mus\u00ed u dlouhodob\u00fdch n\u00e1jm\u016f v\u017edy vy\u00fa\u010dtovat. K&nbsp;obsahu vy\u00fa\u010dtov\u00e1n\u00ed m\u00e1m n\u00e1sleduj\u00edc\u00ed n\u00e1mitky.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Podle z\u00e1kona \u010d. 67\/2013 Sb. jste ve vy\u00fa\u010dtov\u00e1n\u00ed povinen uv\u00e9st skute\u010dnou v\u00fd\u0161i n\u00e1klad\u016f na slu\u017eby v \u010dlen\u011bn\u00ed podle poskytovan\u00fdch slu\u017eeb se v\u0161emi pot\u0159ebn\u00fdmi n\u00e1le\u017eitostmi, v\u010detn\u011b uveden\u00ed celkov\u00e9 v\u00fd\u0161e p\u0159ijat\u00fdch m\u011bs\u00ed\u010dn\u00edch z\u00e1loh za slu\u017eby tak, aby v\u00fd\u0161e p\u0159\u00edpadn\u00fdch rozd\u00edl\u016f ve vy\u00fa\u010dtov\u00e1n\u00ed byla z\u0159ejm\u00e1 a kontrolovateln\u00e1 z hlediska zp\u016fsob\u016f a pravidel sjednan\u00fdch pro roz\u00fa\u010dtov\u00e1n\u00ed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ve V\u00e1mi zaslan\u00e9m vy\u00fa\u010dtov\u00e1n\u00ed informace o skute\u010dn\u00e9 v\u00fd\u0161i n\u00e1klad\u016f za slu\u017eby, kter\u00e9 v&nbsp;souvislosti s&nbsp;n\u00e1jmem bytu zaji\u0161\u0165ujete, bohu\u017eel, chyb\u00ed.
