Zat\u00edmco tyto spole\u010dnosti moc dob\u0159e v\u011bd\u00ed, co d\u011blaj\u00ed, nebo\u0165 je to i smyslem jejich podnik\u00e1n\u00ed, u vlastn\u00edka bytu nebo jeho u\u017eivatele tomu tak b\u00fdt nemus\u00ed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Jak to funguje?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Spole\u010dnost uzav\u0159e s&nbsp;vlastn\u00edkem bytu smlouvu o n\u00e1jmu bytu s&nbsp;t\u00edm, \u017ee tento byt d\u00e1l poskytne do podn\u00e1jmu t\u0159et\u00ed osob\u011b. C\u00edlem tohoto jedn\u00e1n\u00ed je obej\u00edt donucuj\u00edc\u00ed ustanoven\u00ed ob\u010dansk\u00e9ho z\u00e1kon\u00edku o ochran\u011b n\u00e1jemce, nebo\u0165 se m\u00e1 za to, \u017ee podn\u00e1jemce bytu nen\u00ed v&nbsp;tomto p\u0159\u00edpad\u011b chr\u00e1n\u011bn stejn\u011b jako jeho n\u00e1jemce. Podn\u00e1jemn\u00ed smlouva pak obsahuje \u0159adu ustanoven\u00ed, kter\u00e1 jsou v&nbsp;p\u0159\u00edm\u00e9m rozporu se z\u00e1konem v&nbsp;neprosp\u011bch podn\u00e1jemce. Spole\u010dnosti nav\u00edc \u00fa\u010dtuj\u00ed podn\u00e1jemc\u016fm i dal\u0161\u00ed poplatky, na kter\u00e9 nemaj\u00ed ze z\u00e1kona n\u00e1rok naopak je p\u0159\u00edmo z\u00e1konem jejich v\u00fdb\u011br zak\u00e1z\u00e1n (nap\u0159. poplatek za vystaven\u00ed podklad\u016f pro p\u0159\u00edsp\u011bvek bydlen\u00ed, poplatek za zm\u011bnu osob v&nbsp;dom\u00e1cnosti apod.)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Takov\u00fd postup je v\u0161ak je v\u0161ak v&nbsp;rozporu se z\u00e1konem.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pokud vlastn\u00edk bytu pronajme byt pr\u00e1vnick\u00e9 osob\u011b za \u00fa\u010delem toho, aby jej d\u00e1le pronajala (a nikoliv, aby jej sama k&nbsp;bydlen\u00ed u\u017e\u00edvala, co\u017e pr\u00e1vnick\u00e1 osoba ani ze sv\u00e9 podstaty nem\u016f\u017ee) jedn\u00e1 se o <strong>zneu\u017eit\u00ed pr\u00e1va a obch\u00e1zen\u00ed z\u00e1kona.<\/strong> Je-li pak obsahem podn\u00e1jemn\u00ed smlouvy zaji\u0161t\u011bn\u00ed bytov\u00fdch pot\u0159eb podn\u00e1jemce, pou\u017eij\u00ed se na tuto smlouvu donucuj\u00ed stanoven\u00ed ob\u010dansk\u00e9ho z\u00e1kon\u00edku (tj. ust. \u00a7 2235 a n\u00e1sl.) stejn\u011b jako u n\u00e1jemn\u00ed smlouvy uzav\u0159en\u00e9 za t\u00edm sam\u00fdm \u00fa\u010delem.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Op\u011bt se n\u00e1m jedna takto uzav\u0159en\u00e1 \u201epodn\u00e1jemn\u00ed smlouva\u201c dostala do ruky, tentokr\u00e1t od spole\u010dnosti Desire rent s. r. o., tj. <a href=\"http:\/\/www.dokonalynajemnik.cz\">www.dokonalynajemnik.cz<\/a> a Vy se s\u00a0jej\u00edm obsahem m\u016f\u017eete sezn\u00e1mit <a href=\"http:\/\/www.son.cz\/wp-content\/uploads\/2023\/02\/Podnajemni-smlouva.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">ZDE<\/a><a rel=\"noreferrer noopener\" href=\"http:\/\/www.son.cz\/wp-content\/uploads\/2023\/02\/2022_05_02-Podnajemni-smlouva-compressed-compressed.pdf\" target=\"_blank\">.<\/a>\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Z\u00e1jemc\u016fm o pron\u00e1jem bytu za takov\u00fdchto podm\u00ednek <strong>rozhodn\u011b nedoporu\u010dujeme smlouvu podepisovat.<\/strong> V\u017edy se p\u0159ed podpisem jak\u00e9koliv smlouvy pora\u010fte s&nbsp;pr\u00e1vn\u00edkem.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Vlastn\u00edky bytu bychom r\u00e1di upozornili na skute\u010dnost, \u017ee postup t\u011bchto spole\u010dnost\u00ed nen\u00ed v&nbsp;souladu s pr\u00e1vn\u00edmi p\u0159edpisy \u010cR a aby tedy i oni sami pe\u010dliv\u011b zva\u017eovali, jak se svoj\u00ed nemovitost\u00ed nalo\u017e\u00ed. &nbsp;Kone\u010dn\u00e9 d\u016fsledky t\u011bchto protipr\u00e1vn\u00edch jedn\u00e1n\u00ed nakonec ponesou sami a jim tedy doporu\u010dujeme poradit se s&nbsp;pr\u00e1vn\u00edkem, ne\u017e svoji nemovitost p\u0159enechaj\u00ed k&nbsp;jak\u00e9mukoliv u\u017e\u00edv\u00e1n\u00ed jin\u00e9 osob\u011b.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Sou\u010dasn\u00e1 doba je t\u011b\u017ek\u00e1 pro v\u011bt\u0161inu z\u00a0n\u00e1s.
