Do podn\u00e1jemn\u00edch smluv systematicky vkl\u00e1daj\u00ed celou \u0159adu poplatk\u016f, smluvn\u00edch pokut a omezen\u00ed, kter\u00e1 jsou v rozporu s ob\u010dansk\u00fdm z\u00e1kon\u00edkem. Jde nap\u0159\u00edklad o poplatky za prodlou\u017een\u00ed smlouvy nebo za potvrzen\u00ed o trv\u00e1n\u00ed podn\u00e1jmu, &nbsp;pokuty za chybn\u011b uveden\u00fd variabiln\u00ed symbol p\u0159i platb\u011b n\u00e1jemn\u00e9ho, za neohl\u00e1\u0161en\u00ed zm\u011bny kontaktn\u00edch \u00fadaj\u016f \u010di nenahl\u00e1\u0161en\u00ed ztr\u00e1ty zam\u011bstn\u00e1n\u00ed, o povinnost po\u017e\u00e1dat o souhlas s p\u0159ijet\u00edm osoby bl\u00edzk\u00e9 do dom\u00e1cnosti, z\u00e1kaz kontaktovat vlastn\u00edka nemovitosti nebo komunikovat s osobami p\u0159i n\u00e1sledn\u00fdch prohl\u00eddk\u00e1ch bytu, z\u00e1kaz v\u00fdm\u011bny z\u00e1mku \u010di vlo\u017eky u vstupn\u00edch dve\u0159\u00ed, povinnost nahla\u0161ovat odjezd z bytu na dobu del\u0161\u00ed ne\u017e 14 dn\u016f pod hrozbou sankce v\u00fdpov\u011bdi a dal\u0161\u00ed omezen\u00ed p\u0159i b\u011b\u017en\u00e9m u\u017e\u00edv\u00e1n\u00ed bytu.<\/p>\n\n\n\n<p>Na Sdru\u017een\u00ed n\u00e1jemn\u00edk\u016f \u010cR se v t\u00e9to souvislosti obracej\u00ed n\u00e1jemci, kte\u0159\u00ed v&nbsp;t\u011bchto bytech bydl\u00ed a st\u011b\u017euj\u00ed si na praktiky a p\u0159ehnan\u00e9 po\u017eadavky t\u011bchto spole\u010dnost\u00ed. U\u017eivatel\u00e9 byt\u016f p\u0159itom \u010del\u00ed podm\u00ednk\u00e1m, kter\u00e9 by v klasick\u00e9m n\u00e1jemn\u00edm vztahu nebyly p\u0159\u00edpustn\u00e9.<\/p>\n\n\n\n<p><strong>\u201cOpakovan\u011b jsme poukazovali na to, \u017ee doch\u00e1z\u00ed k obch\u00e1zen\u00ed z\u00e1kona a k zast\u00edr\u00e1n\u00ed skute\u010dn\u00e9 povahy smluvn\u00edch vztah\u016f \u2013 tedy \u017ee smlouvy jsou form\u00e1ln\u011b ozna\u010dov\u00e1ny jako podn\u00e1jemn\u00ed, ale ve skute\u010dnosti se jedn\u00e1 o n\u00e1jem s&nbsp;plnou ochranou pr\u00e1v n\u00e1jemce\u201d, \u0159\u00edk\u00e1 Lenka Vesel\u00e1, p\u0159edsedkyn\u011b Sdru\u017een\u00ed n\u00e1jemn\u00edk\u016f \u010cR.<\/strong><\/p>\n\n\n\n<p>Velmi si v\u00e1\u017e\u00edme toho, \u017ee<strong> Ministerstvo pro m\u00edstn\u00ed rozvoj a Ministerstvo spravedlnosti na\u0161i argumentaci vysly\u0161ela, problematikou se podrobn\u011b zab\u00fdvala a shodla se na tom, \u017ee postup spole\u010dnost\u00ed nen\u00ed v&nbsp;souladu se z\u00e1konem. Spole\u010dn\u00e9 stanovisko zve\u0159ejn\u011bn\u00e9 na webov\u00fdch str\u00e1nk\u00e1ch Ministerstva pro m\u00edstn\u00ed rozvoj <\/strong><a href=\"https:\/\/mmr.gov.cz\/cs\/ministerstvo\/bytova-politika\/najemni-vztahy\/stanoviska\"><strong>https:\/\/mmr.gov.cz\/cs\/ministerstvo\/bytova-politika\/najemni-vztahy\/stanoviska<\/strong><\/a><strong> <\/strong><strong>potvrzuje fakt, \u017ee u\u017eivatel\u00e9 t\u011bchto byt\u016f jsou n\u00e1jemci se v\u0161emi pr\u00e1vy a povinnostmi, kter\u00e9 jim ze z\u00e1kona p\u0159\u00edslu\u0161\u00ed.<\/strong><\/p>\n\n\n\n<p>\u201ePro n\u00e1jemce, kte\u0159\u00ed maj\u00ed t\u00e9m\u011b\u0159 v\u017edy uzav\u0159enou smlouvu maxim\u00e1ln\u011b na rok, je toti\u017e prakticky nemo\u017en\u00e9 se sv\u00fdch pr\u00e1v efektivn\u011b domoci \u2013 soudn\u00ed cesta automaticky p\u0159edstavuje riziko ztr\u00e1ty bydlen\u00ed. Jasn\u00e9 stanovisko obou ministerstev proto p\u0159edstavuje z\u00e1sadn\u00ed posun sm\u011brem ke kultivaci n\u00e1jemn\u00edch vztah\u016f \u201c, dopl\u0148uje Lenka Vesel\u00e1.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Profesion\u00e1ln\u00ed spr\u00e1va ano, obch\u00e1zen\u00ed pr\u00e1v ne.<\/h2>\n\n\n\n<p>Sdru\u017een\u00ed n\u00e1jemn\u00edk\u016f \u010cR zd\u016fraz\u0148uje, \u017ee nen\u00ed proti existenci profesion\u00e1ln\u00edch spr\u00e1vc\u016f \u010di zprost\u0159edkovatel\u016f, kte\u0159\u00ed vlastn\u00edk\u016fm pom\u00e1haj\u00ed s pronaj\u00edm\u00e1n\u00edm byt\u016f. Takov\u00fd model v\u0161ak nesm\u00ed b\u00fdt zalo\u017een na oslabov\u00e1n\u00ed z\u00e1konn\u00fdch pr\u00e1v osob, kter\u00e9 v bytech skute\u010dn\u011b bydl\u00ed.
