Tato p\u0159edstava je ale chybn\u00e1 \u2013 a v n\u011bkter\u00fdch p\u0159\u00edpadech m\u016f\u017ee v\u00e9st i ke ztr\u00e1t\u011b bydlen\u00ed.<\/strong><\/p>\n\n\n\n<p>Podle \u00a7 2221 ob\u010dansk\u00e9ho z\u00e1kon\u00edku vstupuje nov\u00fd vlastn\u00edk nemovitosti p\u0159\u00edmo ze z\u00e1kona do postaven\u00ed pronaj\u00edmatele. P\u0159ech\u00e1zej\u00ed na n\u011bj v\u0161echna pr\u00e1va a povinnosti p\u016fvodn\u00edho vlastn\u00edka \u2013 a pro n\u00e1jemce se tedy nic nem\u011bn\u00ed. <strong>Nen\u00ed tedy t\u0159eba uzav\u00edrat \u017e\u00e1dnou novou smlouvu ani podepisovat jak\u00fdkoliv dodatek.<\/strong> N\u00e1jemn\u00ed vztah pokra\u010duje tak, jak byl sjedn\u00e1n s&nbsp;p\u016fvodn\u00edm vlastn\u00edkem. Z\u00e1rove\u0148 z\u00e1kon n\u00e1jemce chr\u00e1n\u00ed i v tom, \u017ee nov\u00fd vlastn\u00edk nem\u016f\u017ee n\u00e1jem vypov\u011bd\u011bt jen proto, \u017ee byt koupil. Ustanoven\u00ed \u00a7 2224 ob\u010dansk\u00e9ho z\u00e1kon\u00edku jasn\u011b \u0159\u00edk\u00e1, \u017ee zm\u011bna vlastn\u00edka sama o sob\u011b nen\u00ed d\u016fvodem k v\u00fdpov\u011bdi n\u00e1jmu.<\/p>\n\n\n\n<p>P\u0159esto se v praxi \u010dasto st\u00e1v\u00e1, \u017ee nov\u00ed majitel\u00e9, p\u0159\u00edpadn\u011b spr\u00e1vn\u00ed firmy jednaj\u00edc\u00ed jejich jm\u00e9nem, p\u0159edkl\u00e1daj\u00ed n\u00e1jemc\u016fm nov\u00e9 smlouvy nebo dodatky. Ty na prvn\u00ed pohled vypadaj\u00ed jako formalita, ale ve skute\u010dnosti obsahuj\u00ed ustanoven\u00ed, kter\u00e1 zhor\u0161uj\u00ed postaven\u00ed n\u00e1jemce \u2013 zkracuj\u00ed dobu n\u00e1jmu, zvy\u0161uj\u00ed n\u00e1jemn\u00e9, nebo omezuj\u00ed pr\u00e1va n\u00e1jemce. C\u00edlem je \u010dasto usnadnit si mo\u017enost rychl\u00e9ho ukon\u010den\u00ed n\u00e1jmu.<\/p>\n\n\n\n<p>Smutn\u00fdm p\u0159\u00edkladem je p\u0159\u00edb\u011bh pan\u00ed Marie z Prahy, kter\u00e1 \u017eila ve sv\u00e9m byt\u011b p\u0159es 20 let. Kdy\u017e se zm\u011bnil vlastn\u00edk domu, byla po\u017e\u00e1d\u00e1na, aby podepsala \u201epouh\u00fd administrativn\u00ed dodatek\u201c s nov\u00fdmi \u00fadaji o vlastn\u00edkovi.
