Jsme r\u00e1di, \u017ee jsme jako Sdru\u017een\u00ed n\u00e1jemn\u00edk\u016f \u010cR mohli b\u00fdt jedn\u00edm ze spoluautor\u016f. Spole\u010dn\u011b usilujeme o to, aby n\u00e1jemn\u00ed bydlen\u00ed v \u010cesku nebylo zdrojem nejistoty a aby lid\u00e9 nemuseli \u017e\u00edt s pocitem, \u017ee se mohou kdykoli st\u011bhovat.<\/p>\n\n\n\n<p>N\u00e1jemn\u00ed vztahy jsou u n\u00e1s dlouhodob\u011b rozkol\u00edsan\u00e9. Pronaj\u00edmatel\u00e9 se boj\u00ed, \u017ee kdy\u017e naraz\u00ed na probl\u00e9mov\u00e9ho n\u00e1jemn\u00edka, bude trvat roky, ne\u017e situaci vy\u0159e\u0161\u00ed. N\u00e1jemci zase \u017eij\u00ed s obavou, \u017ee i kdy\u017e plat\u00ed a chovaj\u00ed se slu\u0161n\u011b, po n\u011bkolika m\u011bs\u00edc\u00edch jim smlouva skon\u010d\u00ed a bez vysv\u011btlen\u00ed se mus\u00ed st\u011bhovat. \u0158et\u011bzen\u00ed kr\u00e1tkodob\u00fdch smluv je dnes b\u011b\u017en\u00e9 a mnoho lid\u00ed tak nem\u016f\u017ee pl\u00e1novat sv\u016fj \u017eivot dop\u0159edu. Kr\u00e1tk\u00e9 smlouvy se nav\u00edc \u010dasto pou\u017e\u00edvaj\u00ed jako zp\u016fsob, jak obej\u00edt povinnosti pronaj\u00edmatele nebo v\u00fdpov\u011bdn\u00ed d\u016fvody.<\/p>\n\n\n\n<p>Do publikace jsme proto p\u0159inesli n\u00e1vrh, kter\u00fd by pomohl ob\u011bma stran\u00e1m: n\u00e1jemn\u00ed smlouvu na dobu neur\u010ditou se zku\u0161ebn\u00edm rokem na za\u010d\u00e1tku. Prvn\u00ed rok je pro ob\u011b strany p\u0159irozen\u00fdm obdob\u00edm, kdy se uk\u00e1\u017ee, jak spolu funguj\u00ed. Pokud je v\u0161e v po\u0159\u00e1dku, n\u00e1jem pokra\u010duje d\u00e1l, bez neust\u00e1l\u00e9ho obnovov\u00e1n\u00ed kr\u00e1tk\u00fdch smluv. Takov\u00fd model je b\u011b\u017en\u00fd v mnoha zem\u00edch a p\u0159in\u00e1\u0161\u00ed v\u011bt\u0161\u00ed jistotu lidem, kte\u0159\u00ed pot\u0159ebuj\u00ed norm\u00e1ln\u011b bydlet.<\/p>\n\n\n\n<p>Z\u00e1rove\u0148 je pot\u0159eba, aby se spory v n\u00e1jemn\u00edch vztaz\u00edch \u0159e\u0161ily rychleji ne\u017e dnes. Procesy se \u010dasto t\u00e1hnou dlouh\u00e9 m\u011bs\u00edce a\u017e roky, co\u017e \u0161kod\u00ed pronaj\u00edmatel\u016fm i poctiv\u00fdm n\u00e1jemc\u016fm. Proto navrhujeme vznik jednoduch\u00e9ho a rychl\u00e9ho \u0159\u00edzen\u00ed p\u0159es \u201earbitra pro n\u00e1jemn\u00ed vztahy\u201c, kter\u00fd by spory rozhodoval m\u00edsto zdlouhav\u00fdch soud\u016f.<\/p>\n\n\n\n<p>Sou\u010d\u00e1st\u00ed na\u0161ich n\u00e1vrh\u016f je i rozumn\u011bj\u0161\u00ed p\u0159\u00edstup k dan\u00edm. Je rozd\u00edl mezi \u010dlov\u011bkem, kter\u00fd m\u00e1 jeden \u010di dva byty a pronaj\u00edm\u00e1 je kv\u016fli rodin\u011b nebo jako dlouhodobou investici, a n\u011bk\u00fdm, kdo vlastn\u00ed des\u00edtky byt\u016f jako podnik\u00e1n\u00ed. Da\u0148ov\u00fd syst\u00e9m by s t\u00edm m\u011bl po\u010d\u00edtat. Z\u00e1rove\u0148 je pot\u0159eba \u0159e\u0161it situaci pr\u00e1zdn\u00fdch byt\u016f a rozsah kr\u00e1tkodob\u00e9ho ubytov\u00e1n\u00ed, kter\u00e9 ve velk\u00fdch m\u011bstech od\u010derp\u00e1v\u00e1 tis\u00edce byt\u016f z b\u011b\u017en\u00e9ho trhu. Obce by m\u011bly m\u00edt mo\u017enost ur\u010dit, kde a v jak\u00e9m rozsahu je to je\u0161t\u011b \u00fanosn\u00e9.<\/p>\n\n\n\n<p>Velk\u00e9 t\u00e9ma posledn\u00edch let jsou i provize realitn\u00edm kancel\u00e1\u0159\u00edm, kter\u00e9 jsou \u010dasto nespravedliv\u011b p\u0159en\u00e1\u0161eny na n\u00e1jemn\u00edky. N\u00e1jemce si realitku neobjednal a nem\u00e1 mo\u017enost ji obej\u00edt, p\u0159esto mus\u00ed platit poplatky, kter\u00e9 n\u011bkdy dosahuj\u00ed n\u011bkolika n\u00e1jm\u016f. Navrhujeme \u00fapravu z\u00e1kona, kter\u00e1 jasn\u011b stanov\u00ed, \u017ee provizi m\u00e1 platit ten, kdo slu\u017ebu vyu\u017e\u00edv\u00e1 \u2013 tedy pronaj\u00edmatel. Stejn\u011b to funguje nap\u0159\u00edklad v N\u011bmecku a v\u00fdrazn\u011b to sni\u017euje bari\u00e9ry p\u0159i hled\u00e1n\u00ed bydlen\u00ed.<\/p>\n\n\n\n<p>Publikace Platformy pro soci\u00e1ln\u00ed bydlen\u00ed ukazuje, \u017ee dostupn\u011bj\u0161\u00ed n\u00e1jemn\u00ed bydlen\u00ed nen\u00ed vzd\u00e1len\u00e1 vize. Mnoho v\u011bc\u00ed se d\u00e1 zm\u011bnit b\u011bhem n\u011bkolika let: jist\u011bj\u0161\u00ed smlouvy, rychlej\u0161\u00ed \u0159e\u0161en\u00ed spor\u016f, omezen\u00ed zbyte\u010dn\u00fdch poplatk\u016f i lep\u0161\u00ed veden\u00ed st\u00e1tu v oblasti dan\u00ed.
