Dobrou zpr\u00e1vou je, \u017ee samotn\u00e1 pravidla se nem\u011bn\u00ed \u2013 jen se upravuj\u00ed \u010d\u00e1stky, kter\u00e9 u\u017e neodpov\u00eddaly dne\u0161n\u00edm cen\u00e1m. N\u00e1jemn\u00ed smlouvy nen\u00ed pot\u0159eba kv\u016fli zm\u011bn\u011b nijak upravovat.<\/strong><\/p>\n\n\n\n<p>Drobn\u00e9 opravy a b\u011b\u017enou \u00fadr\u017ebu v n\u00e1jemn\u00edch bytech vymezuje <strong>na\u0159\u00edzen\u00ed vl\u00e1dy \u010d. 308\/2015 Sb.<\/strong> To plat\u00ed u\u017e od roku 2015, ale za tu dobu v\u00fdrazn\u011b vzrostly ceny materi\u00e1lu i oprav. Proto vl\u00e1da p\u0159istoupila k nav\u00fd\u0161en\u00ed limit\u016f, aby odpov\u00eddaly sou\u010dasn\u00fdm n\u00e1klad\u016fm.<\/p>\n\n\n\n<p>Co se tedy m\u011bn\u00ed od roku 2026?<\/p>\n\n\n\n<p>Nov\u011b bude mo\u017en\u00e9 pova\u017eovat za drobnou opravu takovou, kter\u00e1 nep\u0159es\u00e1hne <strong>1 500 K\u010d<\/strong> (dosud 1 000 K\u010d). Zvy\u0161uje se tak\u00e9 celkov\u00fd ro\u010dn\u00ed limit na drobn\u00e9 opravy v byt\u011b \u2013 ze <strong>100 na 150 K\u010d za metr \u010dtvere\u010dn\u00ed<\/strong> podlahov\u00e9 plochy. Novinkou do budoucna je i ka\u017edoro\u010dn\u00ed \u00faprava t\u011bchto \u010d\u00e1stek podle inflace.<\/p>\n\n\n\n<p>A\u010dkoliv se limity zvy\u0161uj\u00ed, z\u00e1kladn\u00ed princip z\u016fst\u00e1v\u00e1 po\u0159\u00e1d stejn\u00fd. Podle ob\u010dansk\u00e9ho z\u00e1kon\u00edku mus\u00ed pronaj\u00edmatel udr\u017eovat byt v takov\u00e9m stavu, aby jej bylo mo\u017en\u00e9 bezpe\u010dn\u011b a norm\u00e1ln\u011b u\u017e\u00edvat. N\u00e1jemce hrad\u00ed jen b\u011b\u017enou \u00fadr\u017ebu a drobn\u00e9 opravy, kter\u00e9 souvisej\u00ed s b\u011b\u017en\u00fdm u\u017e\u00edv\u00e1n\u00edm bytu.<\/p>\n\n\n\n<p>Z\u00e1kon z\u00e1rove\u0148 nep\u0159ipou\u0161t\u00ed, aby si pronaj\u00edmatel s n\u00e1jemcem dohodli vy\u0161\u0161\u00ed limity, ne\u017e stanov\u00ed na\u0159\u00edzen\u00ed vl\u00e1dy. Pokud by se ve smlouv\u011b objevila povinnost hradit nap\u0159\u00edklad opravy a\u017e do 5 000 korun, takov\u00e1 dohoda je neplatn\u00e1 \u2013 byla by to nep\u0159im\u011b\u0159en\u00e1 povinnost ulo\u017een\u00e1 n\u00e1jemci. Naopak je mo\u017en\u00e9 domluvit si limity ni\u017e\u0161\u00ed, pokud se na tom ob\u011b strany shodnou.<\/p>\n\n\n\n<p>Dal\u0161\u00ed p\u0159\u00edjemn\u00e1 zpr\u00e1va je, \u017ee zm\u011bna limit\u016f nevy\u017eaduje \u017e\u00e1dn\u00e9 z\u00e1sahy do existuj\u00edc\u00edch smluv.
