V\u011b\u0159\u00edte t\u0159eba tomu, \u017ee bez souhlasu pronaj\u00edmatele nesm\u00edte p\u0159ihl\u00e1sit trval\u00fd pobyt, nebo \u017ee pronaj\u00edmatel m\u00e1 pr\u00e1vo m\u00edt kl\u00ed\u010de od bytu? Nenechte se zm\u00e1st. P\u0159in\u00e1\u0161\u00edme p\u0159ehled nej\u010dast\u011bj\u0161\u00edch omyl\u016f a vysv\u011btlujeme, jak je to doopravdy.<\/p>\n\n\n\n<p><strong>Nem\u00e1m p\u00edsemnou smlouvu, nem\u00e1m tedy \u017e\u00e1dn\u00e1 pr\u00e1va.<\/strong><\/p>\n\n\n\n<p>I \u00fastn\u00ed smlouva je platn\u00e1 a d\u00e1v\u00e1 n\u00e1jemci stejn\u00e1 pr\u00e1va a povinnosti jako p\u00edsemn\u00e1. Probl\u00e9m je v tom, \u017ee se pak obt\u00ed\u017en\u011bji prokazuje, co bylo skute\u010dn\u011b dohodnuto. Proto v\u017edy doporu\u010dujeme m\u00edt n\u00e1jemn\u00ed smlouvu v p\u00edsemn\u00e9 podob\u011b. P\u00edsemn\u00e1 n\u00e1jemn\u00ed smlouva je pot\u0159eba v\u017edy, pokud budete pot\u0159ebovat finan\u010dn\u00ed podporu od st\u00e1tu. M\u011bjte ji uzav\u0159enou je\u0161t\u011b p\u0159ed t\u00edm, ne\u017e se do bytu nast\u011bhujete.<\/p>\n\n\n\n<p><strong>Pot\u0159ebuji novou n\u00e1jemn\u00ed smlouvu, proto\u017ee se zm\u011bnil vlastn\u00edk bytu nebo z\u00e1kon.<\/strong><\/p>\n\n\n\n<p>Zm\u011bna vlastn\u00edka bytu neznamen\u00e1 povinnost uzav\u0159\u00edt novou n\u00e1jemn\u00ed smlouvu. N\u00e1jemn\u00ed vztah p\u0159ech\u00e1z\u00ed ze z\u00e1kona (ust. \u00a7 2221 Ob\u010dZ) na nov\u00e9ho vlastn\u00edka, kter\u00fd automaticky nastupuje do postaven\u00ed pronaj\u00edmatele. Nen\u00ed pot\u0159eba uzav\u00edrat ani dodatek ke smlouv\u011b.&nbsp; Stejn\u011b tak platnost n\u00e1jemn\u00ed smlouvy nezanik\u00e1 kv\u016fli zm\u011bn\u00e1m z\u00e1kona \u2013 m\u011bn\u00ed se jen pr\u00e1vn\u00ed r\u00e1mec, nikoli samotn\u00e1 dohoda. Nikdy nic nepodepisujete bez kontroly. Pokud si nejste jist\u00ed, zda je po\u017eadavek pronaj\u00edmatele opr\u00e1vn\u011bn\u00fd, ozv\u011bte se n\u00e1m.<\/p>\n\n\n\n<p><strong>Bez souhlasu pronaj\u00edmatele nem\u016f\u017eu \u010dleny sv\u00e9 dom\u00e1cnosti p\u0159ihl\u00e1sit k trval\u00e9mu pobytu.<\/strong><\/p>\n\n\n\n<p>P\u0159ihl\u00e1\u0161en\u00ed k trval\u00e9mu pobytu nen\u00ed podm\u00edn\u011bno souhlasem pronaj\u00edmatele. Sta\u010d\u00ed platn\u00e1 n\u00e1jemn\u00ed smlouva. Zaps\u00e1n\u00ed trval\u00e9ho pobytu nem\u00e1 vliv na vlastnick\u00e9 pr\u00e1vo k bytu a neznamen\u00e1 \u017e\u00e1dn\u00e9 pr\u00e1vo k setrv\u00e1n\u00ed v byt\u011b po skon\u010den\u00ed n\u00e1jmu.<\/p>\n\n\n\n<p><strong>Plat\u00edm n\u00e1jemn\u00e9 v\u010das, proto m\u011b nikdo nem\u016f\u017ee vyst\u011bhovat.<\/strong><\/p>\n\n\n\n<p>V\u010dasn\u00e9 placen\u00ed n\u00e1jmu je z\u00e1klad, ale neznamen\u00e1 to, \u017ee je pak n\u00e1jemn\u00ed smlouva sjedn\u00e1na \u201ena v\u011bky\u201c. N\u00e1jem kon\u010d\u00ed uplynut\u00edm sjednan\u00e9 doby n\u00e1jmu, dohodou nebo v\u00fdpov\u011bd\u00ed. Pronaj\u00edmatel m\u016f\u017ee n\u00e1jem ukon\u010dit p\u00edsemnou v\u00fdpov\u011bd\u00ed z d\u016fvod\u016f stanoven\u00fdch z\u00e1konem. V\u00fdpov\u011b\u010f mus\u00ed b\u00fdt p\u00edsemn\u00e1, mus\u00ed b\u00fdt doru\u010dena n\u00e1jemci, mus\u00ed v&nbsp;n\u00ed b\u00fdt uveden konkr\u00e9tn\u00ed d\u016fvod a pou\u010den\u00ed o pr\u00e1vu n\u00e1jemce navrhnout p\u0159ezkoum\u00e1n\u00ed opr\u00e1vn\u011bnosti v\u00fdpov\u011bdi soudem, jinak je v\u00fdpov\u011b\u010f neplatn\u00e1.<\/p>\n\n\n\n<p><strong>Pokud nep\u0159istoup\u00edm na zv\u00fd\u0161en\u00ed n\u00e1jemn\u00e9ho, m\u016f\u017eu dostat v\u00fdpov\u011b\u010f z n\u00e1jmu.<\/strong><\/p>\n\n\n\n<p>N\u00e1jemn\u00e9 se zvy\u0161uje zp\u016fsobem dohodnut\u00fdm v&nbsp;n\u00e1jemn\u00ed smlouv\u011b. Pokud postup pro zvy\u0161ov\u00e1n\u00ed n\u00e1jemn\u00e9ho smlouva neobsahuje, postupuje se podle ust. \u00a7 2249 ob\u010dansk\u00e9ho z\u00e1kon\u00edku. Pronaj\u00edmatel m\u016f\u017ee p\u00edsemn\u011b navrhnout n\u00e1jemci zv\u00fd\u0161en\u00ed n\u00e1jemn\u00e9ho a\u017e do v\u00fd\u0161e obvykl\u00e9 v dan\u00e9 lokalit\u011b. Celkov\u00e9 zv\u00fd\u0161en\u00ed za posledn\u00ed t\u0159i roky v\u0161ak nesm\u00ed p\u0159es\u00e1hnout 20 %. Takov\u00fd n\u00e1vrh lze podat nejd\u0159\u00edve po roce od posledn\u00edho zv\u00fd\u0161en\u00ed a mus\u00ed obsahovat novou v\u00fd\u0161i n\u00e1jemn\u00e9ho i od\u016fvodn\u011bn\u00ed. Pokud n\u00e1jemce s n\u00e1vrhem souhlas\u00ed, za\u010dne platit zv\u00fd\u0161en\u00e9 n\u00e1jemn\u00e9 od t\u0159et\u00edho m\u011bs\u00edce po obdr\u017een\u00ed n\u00e1vrhu. Jestli\u017ee se do dvou m\u011bs\u00edc\u016f p\u00edsemn\u011b nevyj\u00e1d\u0159\u00ed, m\u016f\u017ee pronaj\u00edmatel do dal\u0161\u00edch t\u0159\u00ed m\u011bs\u00edc\u016f po\u017e\u00e1dat soud, aby o v\u00fd\u0161i n\u00e1jemn\u00e9ho rozhodl. Soud ur\u010d\u00ed n\u00e1jemn\u00e9 dle m\u00edstn\u00ed obvykl\u00e9 v\u00fd\u0161e, a to zp\u011btn\u011b k datu pod\u00e1n\u00ed n\u00e1vrhu. Nesouhlas\u00ed-li n\u00e1jemce se zv\u00fd\u0161en\u00edm, neznamen\u00e1 to, \u017ee m\u016f\u017ee b\u00fdt hned vyst\u011bhov\u00e1n. V\u00fdpov\u011b\u010f z tohoto d\u016fvodu by byla neopr\u00e1vn\u011bn\u00e1.<\/p>\n\n\n\n<p>Bohu\u017eel, jin\u00e1 pravidla plat\u00ed pro n\u00e1jemn\u00ed smlouvy uzav\u0159en\u00e9 na dobu ur\u010ditou. Po skon\u010den\u00ed sjednan\u00e9 doby n\u00e1jmu je pouze na dohod\u011b pronaj\u00edmatele a n\u00e1jemce za jak\u00fdch podm\u00ednek a zda v\u016fbec budou v&nbsp;n\u00e1jmu pokra\u010dovat.<\/p>\n\n\n\n<p><strong>Ukon\u010d\u00edm-li n\u00e1jem p\u0159ed uplynut\u00edm sjednan\u00e9 doby, nem\u00e1m n\u00e1rok na vr\u00e1cen\u00ed kauce.<\/strong><\/p>\n\n\n\n<p>Z\u00e1kon kauci (jistotu) nev\u00e1\u017ee na d\u00e9lku n\u00e1jmu, ale na pokryt\u00ed p\u0159\u00edpadn\u00fdch dluh\u016f \u010di \u0161kod. Pokud n\u00e1jemce \u0159\u00e1dn\u011b uhrad\u00ed v\u0161e, co m\u011bl, a byt vr\u00e1t\u00ed v po\u0159\u00e1dku, m\u00e1 n\u00e1rok na vr\u00e1cen\u00ed kauce i p\u0159i p\u0159ed\u010dasn\u00e9m ukon\u010den\u00ed n\u00e1jmu \u2013 i kdy\u017e \u0161lo o n\u00e1jem na dobu ur\u010ditou.<\/p>\n\n\n\n<p><strong>Kdy\u017e si n\u011bco oprav\u00edm, m\u016f\u017eu si to ode\u010d\u00edst z n\u00e1jmu.<\/strong><\/p>\n\n\n\n<p>Bez dohody s pronaj\u00edmatelem to neplat\u00ed. N\u00e1jemce prov\u00e1d\u00ed b\u011b\u017enou \u00fadr\u017ebu a drobn\u00e9 opravy podle na\u0159\u00edzen\u00ed vl\u00e1dy 308\/2015 Sb. V\u011bt\u0161\u00ed opravy \u010di \u00fapravy bytu (nap\u0159. v\u00fdm\u011bna plynov\u00e9ho kotle, rekonstrukce koupelny) zaji\u0161\u0165uje pronaj\u00edmatel. Pokud n\u00e1jemce ud\u011bl\u00e1 \u00fapravu nebo v\u011bt\u0161\u00ed opravu bez souhlasu a v\u011bdom\u00ed pronaj\u00edmatele, nem\u00e1 automaticky pr\u00e1vo ode\u010d\u00edst si n\u00e1klady z n\u00e1jmu. V n\u011bkter\u00fdch p\u0159\u00edpadech m\u016f\u017ee sv\u00fdm jedn\u00e1n\u00edm poru\u0161it z\u00e1kon a pronaj\u00edmatel mu m\u016f\u017ee d\u00e1t v\u00fdpov\u011b\u010f z&nbsp;n\u00e1jmu.<\/p>\n\n\n\n<p><strong>Pronaj\u00edmatel m\u00e1 pr\u00e1vo m\u00edt kl\u00ed\u010de od bytu.<\/strong><\/p>\n\n\n\n<p>Nem\u00e1. Jakmile n\u00e1jemce p\u0159evezme byt do u\u017e\u00edv\u00e1n\u00ed, m\u00e1 v\u00fdlu\u010dn\u00e9 pr\u00e1vo v n\u011bm bydlet a pronaj\u00edmatel do n\u011bj nesm\u00ed vstupovat bez jeho souhlasu. V\u00fdjimkou jsou krizov\u00e9 situace (nap\u0159. hav\u00e1rie), ale i tam je t\u0159eba postupovat s respektem k pr\u00e1vu na soukrom\u00ed.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>Pokud si nejste jisti sv\u00fdmi pr\u00e1vy a povinnostmi \u2013 a\u0165 u\u017e jste n\u00e1jemce, nebo pronaj\u00edmatel \u2013 nev\u00e1hejte se na n\u00e1s obr\u00e1tit. Ve Sdru\u017een\u00ed n\u00e1jemn\u00edk\u016f \u010cR nab\u00edz\u00edme poradenstv\u00ed v oblasti n\u00e1jemn\u00edho bydlen\u00ed, pom\u016f\u017eeme v\u00e1m vyznat se ve smluvn\u00edch podm\u00ednk\u00e1ch i v z\u00e1konn\u00fdch pravidlech. Vysv\u011btl\u00edme, co m\u016f\u017eete po\u017eadovat, co jeVva\u0161e odpov\u011bdnost a jak\u00e1 m\u00e1te pr\u00e1va.
