Pronaj\u00edmatel tak m\u016f\u017ee kauci vyu\u017e\u00edt na nezaplacen\u00e9 n\u00e1jemn\u00e9, neuhrazen\u00e9 platby za slu\u017eby spojen\u00e9 s u\u017e\u00edv\u00e1n\u00edm bytu nebo na jin\u00e9 dluhy n\u00e1jemce. Kauce m\u016f\u017ee slou\u017eit tak\u00e9 jako z\u00e1ruka na n\u00e1hradu \u0161kod, kter\u00e9 n\u00e1jemce v dom\u011b nebo v byt\u011b m\u016f\u017ee zp\u016fsobit.<\/p>\n\n\n\n<p>Podm\u00ednkou pro vznik povinnosti n\u00e1jemce kauci pronaj\u00edmateli poskytnout je p\u0159edchoz\u00ed <strong>dohoda<\/strong> n\u00e1jemce a pronaj\u00edmatele. K uzav\u0159en\u00ed takov\u00e9 dohody m\u016f\u017ee doj\u00edt jednak p\u0159i vzniku n\u00e1jmu v r\u00e1mci uzav\u00edr\u00e1n\u00ed nov\u00e9 n\u00e1jemn\u00ed smlouvy nebo i v pr\u016fb\u011bhu trvan\u00ed n\u00e1jemn\u00edho vztahu samostatnou dohodou. Pokud k uzav\u0159en\u00ed takov\u00e9 dohody nedojde, pronaj\u00edmatel nen\u00ed opr\u00e1vn\u011bn slo\u017een\u00ed kauce po n\u00e1jemci vym\u00e1hat.<\/p>\n\n\n\n<p>V\u00fd\u0161e jistoty je tak\u00e9 v\u011bc\u00ed dohody smluvn\u00edch stran, ob\u010dansk\u00fd z\u00e1kon\u00edk v&nbsp;ustanoven\u00ed \u00a7 2254 pouze ur\u010duje, \u017ee <strong>jistota nesm\u00ed b\u00fdt spolu se smluvn\u00ed pokutou vy\u0161\u0161\u00ed ne\u017e trojn\u00e1sobek m\u011bs\u00ed\u010dn\u00edho n\u00e1jemn\u00e9ho <\/strong>(nap\u0159. je-li n\u00e1jemn\u00e9 sjednan\u00e9 ve v\u00fd\u0161i 7.000, &#8211; K\u010d, &#8211; a platby za slu\u017eby ve v\u00fd\u0161i 2.000, &#8211; K\u010d, nesm\u00ed b\u00fdt kauce vy\u0161\u0161\u00ed ne\u017e 21.000, &#8211; K\u010d, proto\u017ee platby za slu\u017eby se do limitu nezapo\u010d\u00edt\u00e1vaj\u00ed). Nem\u00e1-li n\u00e1jemce dostatek finan\u010dn\u00edch prost\u0159edk\u016f na kauci, m\u016f\u017ee se obr\u00e1tit o pomoc na p\u0159\u00edslu\u0161en\u00fd \u00fa\u0159ad pr\u00e1ce a po\u017e\u00e1dat o d\u00e1vku mimo\u0159\u00e1dn\u00e9 okam\u017eit\u00e9 pomoci <a href=\"https:\/\/www.mpsv.cz\/-\/mimoradna-okamzita-pomoc\">https:\/\/www.mpsv.cz\/-\/mimoradna-okamzita-pomoc<\/a>.<\/p>\n\n\n\n<p>Ob\u010dansk\u00fd z\u00e1kon\u00edk neupravuje \u017e\u00e1dn\u00e9 ustanoven\u00ed t\u00fdkaj\u00edc\u00ed se povinnosti n\u00e1jemce dopl\u0148ovat jistotu pro p\u0159\u00edpad jej\u00edho \u010derp\u00e1n\u00ed v pr\u016fb\u011bhu trv\u00e1n\u00ed n\u00e1jemn\u00edho vztahu. Bude tedy z\u00e1le\u017eet zejm\u00e9na na dohod\u011b pronaj\u00edmatele a n\u00e1jemce, jak\u00fdm zp\u016fsobem a zda v\u016fbec, si tato pravidla uprav\u00ed. Z\u00e1kon tak\u00e9 ne\u0159e\u0161\u00ed <strong>zp\u016fsob p\u0159echov\u00e1v\u00e1n\u00ed jistoty<\/strong> pronaj\u00edmatelem. Pronaj\u00edmatel tedy m\u016f\u017ee pen\u011b\u017en\u00ed prost\u0159edky slo\u017eit kamkoliv nebo komukoliv uzn\u00e1 za vhodn\u00e9, nen\u00ed nutn\u00e9, aby kauce byla slo\u017eena na zvl\u00e1\u0161tn\u00edm \u00fa\u010dtu, s finan\u010dn\u00edmi prost\u0159edky m\u016f\u017ee pronaj\u00edmatel voln\u011b nakl\u00e1dat a to doby, kdy je povinen n\u00e1jemci kauci vr\u00e1tit.<\/p>\n\n\n\n<p><strong>Pronaj\u00edmatel je povinen vr\u00e1tit jistotu n\u00e1jemci p\u0159i skon\u010den\u00ed n\u00e1jmu<\/strong>. Vr\u00e1cen\u00ed kauce je tedy v\u00e1z\u00e1no na okam\u017eik skon\u010den\u00ed n\u00e1jmu, nikoliv na okam\u017eik vyklizen\u00ed bytu. Vr\u00e1cen\u00ed kauce pozd\u011bji, ne\u017e v posledn\u00ed den n\u00e1jmu mus\u00ed b\u00fdt s&nbsp;n\u00e1jemcem v\u00fdslovn\u011b dohodnuto v&nbsp;n\u00e1jemn\u00ed smlouv\u011b nebo jej\u00edm dodatku a mus\u00ed to b\u00fdt v&nbsp;z\u00e1jmu n\u00e1jemce, jinak se&nbsp;k&nbsp;takov\u00e9mu ujedn\u00e1n\u00ed nep\u0159ihl\u00ed\u017e\u00ed (pronaj\u00edmatel nap\u0159. nem\u016f\u017ee zadr\u017eovat celou kauci p\u016fl roku jen kv\u016fli tomu, \u017ee nem\u00e1 k&nbsp;dispozici vy\u00fa\u010dtov\u00e1n\u00ed slu\u017eeb).<\/p>\n\n\n\n<p>Pronaj\u00edmatel m\u00e1 pr\u00e1vo si p\u0159i skon\u010den\u00ed n\u00e1jmu v\u016f\u010di jistot\u011b zapo\u010d\u00edst to, co mu n\u00e1jemce z n\u00e1jmu dlu\u017e\u00ed. N\u00e1jemci je pronaj\u00edmatel povinen kauci vy\u00fa\u010dtovat a dolo\u017eit, na jak\u00e9 konkr\u00e9tn\u00ed dluhy kauci pou\u017eil.&nbsp; Sou\u010dasn\u011b je z\u00e1konem n\u00e1jemci garantov\u00e1no <strong>pr\u00e1vo na v\u00fdplatu \u00farok\u016f<\/strong> z jistoty za dobu od jej\u00edho poskytnut\u00ed do jej\u00edho vr\u00e1cen\u00ed. V\u00fd\u0161e \u00farok\u016f z jistoty m\u016f\u017ee b\u00fdt p\u0159edm\u011btem dohody smluvn\u00edch stran, sou\u010dasn\u011b ob\u010dansk\u00fd z\u00e1kon\u00edk stanov\u00ed, \u017ee n\u00e1jemce m\u00e1 n\u00e1rok na \u00faroky alespo\u0148 v z\u00e1konn\u00e9 v\u00fd\u0161i. Vzhledem k&nbsp;tomu, \u017ee&nbsp;<strong>z\u00e1kon \u017e\u00e1dnou konkr\u00e9tn\u00ed \u00farokovou sazbu, bohu\u017eel, nestanov\u00ed<\/strong>, je pot\u0159eba pou\u017e\u00edt obecn\u00e9 ustanoven\u00ed ob\u010dansk\u00e9ho z\u00e1kon\u00edku o \u00faroc\u00edch (\u00a7 1802), podle n\u011bho\u017e plat\u00ed dlu\u017en\u00edk obvykl\u00e9 \u00faroky po\u017eadovan\u00e9 za \u00fav\u011bry, kter\u00e9 banky poskytuj\u00ed v m\u00edst\u011b bydli\u0161t\u011b nebo s\u00eddla dlu\u017en\u00edka v dob\u011b uzav\u0159en\u00ed smlouvy. Soudn\u00ed praxe n\u00e1sledn\u011b dovodila, \u017ee se v tomto p\u0159\u00edpad\u011b vych\u00e1z\u00ed z \u00farokov\u00fdch sazeb \u00fav\u011br\u016f \u00fa\u010dtovan\u00fdmi bankami dom\u00e1cnostem v dob\u011b, kdy byla kauce slo\u017eena, p\u0159i\u010dem\u017e obecn\u00e9 soudy vych\u00e1zely z pr\u016fm\u011brn\u00fdch \u00farokov\u00fdch sazeb publikovan\u00fdch na webov\u00fdch str\u00e1nk\u00e1ch \u010cNB. K v\u011bci se vyj\u00e1d\u0159il i \u00dastavn\u00ed soud (2022), kter\u00fd tento postup ozna\u010dil za z\u00e1konn\u00fd a legitimn\u00ed a konstatoval, \u017ee nijak nesni\u017euje pr\u00e1va pronaj\u00edmatele. <\/p>\n\n\n\n<p><strong>Nelze se platn\u011b domluvit s&nbsp;n\u00e1jemcem na tom, \u017ee n\u00e1rok na \u00faroky nem\u00e1<\/strong>. K&nbsp;takov\u00e9mu ujedn\u00e1n\u00ed ve smlouv\u011b se nep\u0159ihl\u00ed\u017e\u00ed &#8211; zkracovala by se t\u00edm n\u00e1jemcova pr\u00e1va. Nelze se tak\u00e9 platn\u011b dohodnout na tom, \u017ee n\u00e1jemce m\u00e1 n\u00e1rok na \u00faroky ve v\u00fd\u0161i, kter\u00e1 je ni\u017e\u0161\u00ed, ne\u017e jsou \u00faroky v&nbsp;z\u00e1konn\u00e9 v\u00fd\u0161i, op\u011bt by se zkracovala n\u00e1jemcova pr\u00e1va (\u00a7 2235 OZ).<\/p>\n\n\n\n<p>Institut jistoty (kauce) je v ob\u010dansk\u00e9m z\u00e1kon\u00edku upraven problematicky. Jednak z&nbsp;d\u016fvodu stanoven\u00ed \u00farokov\u00e9 sazby, d\u00e1le pak tak\u00e9 z&nbsp;d\u016fvodu mo\u017enosti pronaj\u00edmatele nakl\u00e1dat s&nbsp;finan\u010dn\u00edmi prost\u0159edky n\u00e1jemce libovoln\u011b \u2013 jakkoliv uzn\u00e1 za vhodn\u00e9, bez jak\u00e9koliv kontroly. Pokud pronaj\u00edmatel kauci po skon\u010den\u00ed n\u00e1jmu nevr\u00e1t\u00ed, mus\u00ed se n\u00e1jemce obr\u00e1tit k&nbsp;p\u0159\u00edslu\u0161n\u00e9mu soudu a dom\u00e1hat se sv\u00e9ho n\u00e1roku u n\u011bj. Bylo by vhodn\u00e9, kdyby se v&nbsp;tomto smyslu zm\u011bnilo p\u0159\u00edslu\u0161n\u00e9 ustaven\u00ed z\u00e1kona a byla stanovena konkr\u00e9tn\u00ed pravidla pro nakl\u00e1dan\u00ed s&nbsp;kauc\u00ed po dobu, kdy ji pronaj\u00edmatel dr\u017e\u00ed a pronaj\u00edmatel by sou\u010dasn\u011b nemohl s&nbsp;finan\u010dn\u00edmi prost\u0159edky voln\u011b nakl\u00e1dat.
